Assault

Assault involves, not the striking of another person, but "an apprehension in another of an imminent harmful or offensive contact." In other words, it is action that creates a fear of harm. If a person draws back his fist, that could be assault. If he hits you, that is battery.

To sue for assault, of course, one must prove that you suffered some sort of damage because of the assault.
